{"id":1014,"date":"2023-05-23T15:41:18","date_gmt":"2023-05-23T19:41:18","guid":{"rendered":"https:\/\/grishamandpoole.com\/blog\/?p=1014"},"modified":"2023-07-31T23:26:49","modified_gmt":"2023-08-01T03:26:49","slug":"what-are-my-rights-if-ga-dfcs-come-to-my-house","status":"publish","type":"post","link":"https:\/\/grishamandpoole.com\/blog\/what-are-my-rights-if-ga-dfcs-come-to-my-house\/","title":{"rendered":"What Are My Rights if GA DFCS Come to My House"},"content":{"rendered":"\n<h2>What authority does DFCS have in Georgia?<\/h2>\n<p>Getting a knock on the door from a representative of the Department of Family and Children\u2019s Services (DFCS) can be a confusing, upsetting, and traumatic experience for parents, children, and everyone who loves and cares about them. The Department of Family and Children\u2019s Services\u2019 role is to protect children from abuse and neglect, but DFCS doesn\u2019t always get it right. If DFCS becomes involved with your family, you should immediately contact a family law attorney. <a href=\"https:\/\/law.justia.com\/codes\/georgia\/2020\/title-15\/chapter-11\/article-3\/part-3\/section-15-11-133\/\" title=\"See the law about removing children from a home\">DFCS has the authority to remove your children from your home<\/a> with a signed order from a judge. From there, several hearings will take place, and it is important that you are represented by an experienced attorney at every stage of the process.<\/p>\n\n<p>If the Judge finds probable cause to believe that your children are &#8220;dependent,&#8221; meaning they are the victims of abuse and neglect and require protection from the State, an adjudication hearing will be scheduled and the parties to the case will have the opportunity to prove or refute the allegations made by DFCS. This process can take several months, which leaves your children in limbo and in the temporary custody of DFCS.<\/p>\n\n<h3>Juvenile Dependency Attorneys<\/h3>\n<p>Several attorneys are involved in juvenile dependency cases in Cherokee County.
