A person commits the offense of aggravated child molestation when such person commits an offense of child molestation which act physically injures the child or involves an act of sodomy. Aggravated Child Molestation is one of Georgia's Seven Deadly Sins crimes.
A strong defense to an aggravated sodomy charge in Georgia begins with getting our clients side of the story. Next, we do a critical review of police reports, all evidence, and the story told by the prosecutors.
Our attorneys can challenge the ability of the State to prove the existence of the acts that warrant the charges. We can have civil discussions to determine if the prosecutor's office actually knows the facts, or they are just building a story around some weak evidence and heresay. This may be enough to get the charges dropped.
If the case mover forward, our attorneys can weaken the State's case by finding flaws in the investigation process, and having certain "evidence" ruled inadmissable. Often, there are clear flaws with police procedures during questioning, arrest, or evidence collection. Our attorneys can go on the offensive by establishing an alibi, utilizing text messages, video recordings, and medical reports to counter the prosecution. And, perhaps most importantly, we are extremely competent in jury trials. When we are in front of a jury, we have the opportunity to show unbiased decision makers that the prosecutor has not earned a conviction.
A person convicted of aggravated child molestation shall be punished by imprisonment for life or by a split sentence that is a term of imprisonment for not less than 25 years and not exceeding life imprisonment, followed by probation for life, and shall be subject to the sentencing and punishment provisions of Code Sections 17-10-6.1 and 17-10-7. Anyone convicted of this crime will be placed on the Georgia Sex Offender Registry.
This charge can possibly be reduced to a misdemeanor charge, IF: the offender is 18 years old (or younger), and is no more than 4 years older than a victim aged 13-16 years old.
